Each gadget sold should match the make and model in the sale order. All items deemed to be working (other than those sold as faulty or damaged where applicable) should meet conditions 1 to 10 below with points 11 and 12 referring to faulty or damaged gadgets:
By submitting an order through our site you warrant that the gadget(s) comply with these terms.
By sending your gadget to us, you agree to release us from all and any claims, losses or damages with respect to the gadget, any data stored or contained therein or on any media used in conjunction with the gadget (whether in the form of personal details, SMS, photos, games, movies, songs or other data ("Data")). We accept no responsibility in relation to the security, protection, confidentiality or use of such data and it is your responsibility to ensure that such data is removed from the gadget prior to you sending it to us. Please ensure that you remove any sim cards as these will be destroyed when an item is processed.
By placing an order through our site, you warrant that:
If you deal as a consumer any provision of this contract which is of no effect to a consumer shall not apply. Your statutory rights are not affected by this contract.
For the purposes of these terms and conditions, "consumer" means an individual who neither makes this contract in the course of a business, nor holds himself out as doing so, as defined by the Unfair Contract Terms Act 1977.
The prices we offer on our website are subject to change at any time without notice. The prices quoted when you place your order are guaranteed for 14 days from the date on which we forward you an order confirmation e-mail. If your gadget is received after 14 days from the order confirmation date then the latest current prices will apply.
We offer the option of bank transfer, PayPal or cheque payments. You will be required to select a payment option when placing each online sell order. It remains the responsibility of the seller to ensure that all payment information provided is correct. The selected payment option cannot be changed once the order is placed.
When we receive your order, we will check that it is complete, and that it meets our terms and conditions. Providing it does, we will post payment by cheque or transfer payment to the relevant bank or PayPal account usually after 2 working days. Payments may in certain instances be delayed for up to 48 hours during busy periods. Cheques could take up to 7 working days to arrive once posted. For bank transfers, funds may take up to 2 hours to show in a seller's account. Payment can only be made to the name and address, PayPal e-mail or bank details given when placing your order.
Any sell it fast collection deposit will be refunded within the total payment amount. Any collection deposit paid by a seller as part of the sell it fast service will not be refunded, where an attempt by our couriers to collect a sell order is unsuccessful, due to one of the following reasons:
If we deem that the condition of the gadget differs from the condition that was described or if a gadget fails to meet our terms and conditions we may propose an adjusted price by email. If you choose not to accept the revised offer, then we'll usually return the gadget free of charge. We will however ask for a return postage payment of £5.90 when an item fails to meet our terms and conditions and we are unable to offer any amount for it, or if a revised offer has been declined and the price was revised for one of the following reasons:
We have the final decision on all gadget values. Revised orders will be automatically processed for payment if you do not reply to our proposed offer email within 5 days.
In the unlikely event that a returned item is lost in the postal system then we will offer compensation up to the amount of our revised offer. Items are returned via Royal Mail recorded delivery and we retain all postage receipts as evidence of return.
We will check the IMEI/Serial number of all mobile phones and devices received on the CheckMEND database of lost and stolen property records to ensure no lost or stolen items are purchased.
If a mobile phone or device is found to have records that indicate it has been lost or stolen, we will notify the seller by email and quarantine the mobile phone or device for 28 days.
If you are informed that your mobile phone is registered lost or stolen, you will be required to contact CheckMEND, prove that you are the rightful owner and have the lost or stolen records associated with it cleared within the 28 day quarantine period.
If during the quarantine period the mobile phone or device is cleared on the CheckMEND database, your sale will be processed and paid for as normal. However, if after the quarantine period has expired and the lost or stolen records have not been cleared, then we are required by law to dispose of the mobile phone or device and you will not receive any payment.
UK legislation states that we cannot under any circumstances return or pay for a mobile phone or device which is registered lost or stolen at any time unless the lost or stolen records associated with it are cleared.
If we at any time become aware of any issues, you will be required to co-operate with the authorities and we reserve the right to withhold or cancel the payment.
All items received in the post that do not contain any order information will be retained for a period of 60 days from the date of receipt, after which time they will be sold. During this 60 day period a seller can lay claim to such an item by providing us with a description of the packaging used and any other distinguishable features of the parcel and or item.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.
